Terms of Service

1. Acceptance of Terms

By accessing or using CRM Stack ("Service", "Platform", "we", "us"), operated by CRM Stack (support@crmstack.co), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms apply to all users including account owners, administrators, and staff members added to an account.

2. Description of Services

CRM Stack is a cloud-based Customer Relationship Management (CRM) platform designed for service businesses including but not limited to cleaning, plumbing, HVAC, pest control, solar, and marketing agencies. Core features include:

  • Lead capture, management, and tracking
  • Visual Kanban sales pipeline
  • Follow-up scheduling and reminders
  • WhatsApp click-to-chat integration
  • Invoice generation and payment tracking
  • Staff management and role-based access
  • Reports and analytics dashboards

Features available to your account depend on the subscription plan you select.

3. Accounts & Registration

To use CRM Stack you must register an account and provide accurate, complete information including your name, business name, and email address. You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Ensuring all staff members you invite comply with these Terms
  • Notifying us immediately at support@crmstack.co if you suspect unauthorised access

You must be at least 18 years old and have legal authority to enter into a binding agreement on behalf of your business.

Accounts are activated only after successful payment. New registrations remain in pending status until a subscription plan is purchased.

4. Payment & Billing

All payments are processed securely by Lemon Squeezy, our authorised payment processor. By subscribing you authorise Lemon Squeezy to charge your selected payment method.

  • Billing cycles: Monthly or annual, chosen at checkout. Annual plans are billed in full upfront.
  • Pricing: Displayed in USD. Prices are subject to change with 30 days' notice.
  • Receipts: Sent automatically to your registered email after each successful payment.
  • Failed payments: If a charge fails, your account may be suspended until payment is resolved.
  • Refunds: We offer a 7-day money-back guarantee on first-time subscriptions. Contact us within 7 days of your initial payment to request a refund.
  • Taxes: Prices are exclusive of applicable taxes. VAT or sales tax may be added depending on your location.

5. Acceptable Use

You agree to use CRM Stack only for lawful business purposes. You must not:

  • Use the Service to store, transmit, or distribute illegal content
  • Attempt to gain unauthorised access to other accounts or systems
  • Reverse-engineer, decompile, or scrape any part of the platform
  • Send spam, unsolicited messages, or harass other users
  • Violate any applicable data protection laws (including GDPR, CCPA) in your use of the platform
  • Use the Service to infringe on any third party's intellectual property rights
  • Resell, sublicense, or white-label the Service without our written permission

We reserve the right to suspend or terminate accounts that violate this policy without notice.

6. Your Data

You own your data. All leads, contacts, invoices, and business data you enter into CRM Stack remain yours. We do not sell or share your data with third parties for marketing purposes.

  • Data isolation: All data is logically isolated per business account (tenant). No other business can access your data.
  • Backups: We perform regular database backups. However, you are responsible for exporting critical data periodically.
  • Data export: You may request a full export of your data at any time by contacting support.
  • Data deletion: Upon account termination, your data is deleted within 30 days unless legally required to retain it.
  • Processing: By using the Service you authorise us to process your data solely to provide and improve the Service.

7. Intellectual Property

CRM Stack, its logo, design, code, and all platform features are the exclusive intellectual property of CRM Stack. These Terms do not grant you any ownership rights to the platform.

You grant us a limited, non-exclusive licence to host, process, and display your content solely as needed to deliver the Service to you.

8. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, unexpected outages, or events beyond our control may cause temporary downtime. We are not liable for any loss caused by service unavailability.

We will endeavour to provide at least 24 hours' notice of planned maintenance via email or in-app notification.

9. Termination

By you: You may cancel your subscription at any time through your billing portal managed by Lemon Squeezy. Access continues until the end of your current paid period.

By us: We may suspend or terminate your account immediately if you:

  • Breach these Terms of Service
  • Fail to pay outstanding subscription fees
  • Engage in fraudulent or illegal activity

Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days post-termination for recovery purposes before permanent deletion.

10. Limitation of Liability

To the maximum extent permitted by law, CRM Stack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total subscription fees you paid in the 3 months preceding the claim.

The Service is provided "as is" without warranties of any kind, express or implied.

11. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

The current version is always available at crmstack.co/terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
